DAILY MART Terms of Service

📋  Agreement to Terms By visiting, shopping at, or otherwise using Daily Mart's services — whether in-store or online — you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please refrain from using our services.

 

These Terms of Service ('Terms') govern your use of Daily Mart's retail services, including in-store purchases, online orders, delivery services, and any other interactions with Daily Mart ('we', 'us', 'our'). These Terms constitute a legally binding agreement between you ('Customer', 'you') and Daily Mart.

By using our services, you confirm that:

•       You are at least 18 years of age, or are using our services under the supervision of a parent or legal guardian.

•       You have the legal capacity to enter into a binding agreement.

•       You will use our services only for lawful purposes and in accordance with these Terms.

Daily Mart reserves the right to refuse service to anyone at its sole discretion.

 

We strive to display accurate product information and pricing at all times. However:

•       Product availability is subject to change without prior notice.

•       Prices are subject to change without notice. The price charged will be the price displayed at the time of purchase.

•       In the event of a pricing error, Daily Mart reserves the right to cancel the order and issue a full refund.

•       All prices are listed in Pakistani Rupees (PKR) and are inclusive of applicable taxes unless stated otherwise.

•       Promotional prices and discounts are valid only for the specified duration and cannot be combined unless explicitly stated.

 

By placing an order with Daily Mart, you agree to the following:

•       You authorize Daily Mart to charge the applicable amount for your purchase at the time of the transaction.

•       Payment must be made in full before goods are released or dispatched.

•       We accept cash, bank transfer, and other payment methods as displayed at the point of sale.

•       Daily Mart reserves the right to cancel any order that appears fraudulent or suspicious.

•       Order confirmation does not guarantee availability; in case of unavailability, a full refund will be issued.

 

Where delivery services are offered:

•       Estimated delivery timelines are provided as a guideline and are not guaranteed.

•       Daily Mart is not liable for delays caused by third-party courier services, weather conditions, or other factors beyond our control.

•       It is the customer's responsibility to provide a correct and complete delivery address. Daily Mart is not responsible for failed deliveries due to incorrect address information.

•       Risk of loss and title for items pass to you upon delivery to the carrier or courier.

•       In-store pickup orders must be collected within 3 days of notification, after which the order may be cancelled and restocked.

 

Returns and refunds are governed by our separate Return & Refund Policy, which is incorporated into these Terms by reference. Key points include:

•       Returns are accepted within 3 days of purchase or delivery.

•       Items must be unused, in original condition, and accompanied by proof of purchase.

•       Electronic items are strictly non-returnable and non-exchangeable.

When using Daily Mart's services, you agree not to:

•       Provide false, misleading, or fraudulent information during any transaction.

•       Attempt to purchase goods with invalid, stolen, or unauthorized payment methods.

•       Engage in any conduct that disrupts, harms, or interferes with the operations of Daily Mart or its staff.

•       Resell Daily Mart products commercially without prior written consent.

•       Misuse any promotional offers, discount codes, or loyalty programs.

•       Harass, threaten, or abuse any Daily Mart staff or other customers.

 

⚠  Zero Tolerance Policy Daily Mart maintains a zero-tolerance policy toward abusive behavior, fraud, theft, or any conduct harmful to our staff, customers, or business. We reserve the right to permanently ban individuals and pursue legal action where appropriate.

 

All content associated with Daily Mart — including but not limited to the trade name, logo, product imagery, marketing materials, and website content — is the exclusive property of Daily Mart. You may not use, reproduce, copy, or distribute any such content without prior written permission from Daily Mart.

 

To the fullest extent permitted by applicable law:

•       Daily Mart shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our products or services.

•       Our total liability in connection with any purchase shall not exceed the original purchase price of the product(s) in question.

•       Daily Mart does not warrant that products will meet your specific expectations beyond what is described at the point of sale.

•       We are not responsible for any personal injury or property damage resulting from misuse of purchased products.

 

Products are sold 'as is' unless a specific manufacturer's warranty is provided. Daily Mart makes no additional warranties, express or implied, including but not limited to warranties of fitness for a particular purpose or merchantability, beyond those legally required or explicitly stated at the time of sale.

 

Your use of Daily Mart's services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of your information as described in the Privacy Policy.

 

These Terms shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. Any disputes arising out of or related to these Terms or your use of Daily Mart's services shall be subject to the exclusive jurisdiction of the courts of Lahore, Punjab, Pakistan.

We encourage customers to first contact us directly to resolve any concerns before initiating formal legal proceedings.

 

Daily Mart reserves the right to update, modify, or replace these Terms of Service at any time. Changes will be effective immediately upon posting or notification. Your continued use of our services after any modification constitutes your acceptance of the revised Terms. We recommend reviewing these Terms periodically.

 

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions.

 

These Terms of Service, together with our Return & Refund Policy and Privacy Policy, constitute the entire agreement between you and Daily Mart with respect to your use of our services, and supersede all prior agreements, representations, or understandings.
